Introduction
Welcome to BetterNamer! These Terms of Service ("Terms") govern your use of the BetterNamer domain name generation and analysis service ("Service") operated by Revision Labs, Inc., a Delaware corporation, doing business as BetterNamer ("BetterNamer," "we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.
Acceptance of Terms
By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.
Description of Service
BetterNamer provides:
- Domain name generation and suggestion services
- Domain availability checking
- AI-powered name analysis and recommendations
- Domain registration, renewal, transfer, and management services, provided as a reseller of one or more ICANN-accredited registrars
- User account management and search history
User Accounts
Account Creation
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old and able to form a binding contract to create an account
- One person may not maintain multiple accounts
Account Responsibilities
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- We reserve the right to suspend or terminate accounts that violate these Terms
Acceptable Use Policy
You agree NOT to use our Service to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights of others
- Generate domain names for illegal, harmful, or fraudulent purposes
- Attempt to reverse engineer or compromise our systems
- Use automated tools to abuse our service or circumvent usage limits
- Harass, abuse, or harm other users
- Upload malicious code or attempt to gain unauthorized access
Intellectual Property
Our Rights
- BetterNamer owns all rights to the Service, including algorithms, software, and branding
- Our trademarks, logos, and service marks are protected intellectual property
- The underlying technology and methodology for name generation is proprietary
Your Rights
- You retain ownership of any original content you provide
- Generated domain name suggestions are provided for your use, but availability is not guaranteed
- You may use our Service results for legitimate business purposes
Third-Party Rights
- Some generated names may be subject to existing trademarks or copyrights
- We do not guarantee that suggested names are free from third-party claims
- You are responsible for conducting your own trademark and legal research
Feedback
If you send us ideas, suggestions, feature requests, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and incorporate that feedback into the Service for any purpose, without any obligation, attribution, or compensation to you. Do not send us feedback you consider confidential or proprietary.
Publicity
- You grant us a non-exclusive, worldwide, royalty-free license to use your name, logo, and trademarks in our marketing materials and on our website to identify you as a BetterNamer user.
- We will only use your branding for the purpose of identifying you as a customer and will comply with any brand guidelines you provide to us.
- You may opt out of this publicity at any time by sending an email to privacy@betternamer.com with the subject line "Publicity Opt-out". Upon receipt of your request, we will remove your name and logo from our marketing materials within 30 days.
Domain Registration
Our Role as a Reseller
- BetterNamer sells domain registration, renewal, and transfer services as a reseller of one or more ICANN-accredited registrars. The registrar we use is the sponsoring registrar of record for domains you purchase through us; BetterNamer is not an ICANN-accredited registrar. Our current registrar partner is Hosting Concepts B.V. d/b/a Openprovider (IANA ID 1647), and the authoritative, maintained list is in section 1 of the Domain Registration Agreement.
- You are the legal owner (registrant) of every domain you register through BetterNamer. Your contact details are submitted to the registry as the domain's owner.
- BetterNamer handles billing for your domains and provides your domain management tools (DNS, renewals, transfers, WHOIS privacy).
We May Add or Change Registrars
- We reserve the right to add additional ICANN-accredited registrars, to change which registrar we use for new registrations, and to transfer domains already registered through BetterNamer to a different accredited registrar. We may also use different registrars for different TLDs at the same time.
- Where a change affects a domain you already own, we will give you at least 30 days' email notice before moving it, we bear the cost, and you may transfer the domain to a registrar of your own choosing instead. The full terms — including the effect on your registration term, renewal pricing, and transfer locks — are in section 2 of the Domain Registration Agreement.
- Because a registrar change means your registrant details are handled by a different accredited registrar, we update the Privacy Policy to name it and treat the change as material for notice purposes.
The Domain Registration Agreement
- Every domain order is additionally governed by our Domain Registration Agreement, which you accept at checkout. It contains the registrant terms required by ICANN policy, including your obligation to keep contact information accurate and the dispute policies (such as the UDRP) that apply to domain names.
- Renewal, expiration, auto-renewal, and deletion — including the applicable fees — are described in the Domain Renewal & Expiration Policy.
- ICANN publishes a summary of your rights and obligations as a registrant: Registrants' Benefits and Responsibilities.
Transfers and Your Control
- You may transfer any domain to another registrar, subject to ICANN's Transfer Policy (including its 60-day post-registration and post-transfer restrictions). We provide your transfer authorization code and unlock your domain within five (5) calendar days of a request — both are available self-serve from your domain dashboard.
No Guarantees
- Domain availability can change rapidly and is not guaranteed until registration completes
- Prices are confirmed at checkout before you pay; availability and premium pricing can change up to that moment
- Registrations are subject to the policies of the sponsoring registrar, the applicable registry, and ICANN
AI and Data Usage
AI Services
- We use various AI services including Google Gemini, OpenAI GPT, and other language models
- Your search queries may be processed by these services to improve name generation
- We anonymize data shared with AI providers where possible
Data Processing
- We collect and analyze usage patterns to improve our algorithms
- Your search history may be stored to provide personalized recommendations
- We may use aggregated, anonymized data for research and development
Credits and Usage Limits
What Credits Are
- Certain features of the Service consume usage credits. Credits may be granted as part of a paid plan's periodic allotment, purchased as one-time top-ups, awarded through referral or promotional programs, or added by us as a courtesy or adjustment.
- Credits are a limited, non-exclusive, non-transferable license to use features of the Service. Credits are not money, property, or a stored-value instrument; they have no cash value, cannot be redeemed for cash, and may not be sold, bartered, or transferred to another account.
- Credits are non-refundable except as described in our Refund Policy or as required by applicable law.
Expiration
- Credits may expire. The applicable expiration period, if any, is shown where the credits are granted or purchased. Expired credits are forfeited and will not be restored.
- Plan allotment credits do not roll over between billing periods unless we expressly state otherwise.
Changes to Credits and Limits
- We may change, on a prospective basis: the number of credits included in any plan, the number of credits a given action consumes, which features require credits, and the expiration period applied to future grants.
- Prospective changes will not reduce the quantity of credits already in your account (other than through your normal consumption or their stated expiration). For material reductions affecting a paid plan, we will provide advance notice, and you may cancel before your next renewal if you do not agree.
- All plans, including free usage, are subject to rate limits and fair-use safeguards designed to protect the Service for all users.
Forfeiture
- Upon termination of your account — by you, or by us for violation of these Terms — any unused credits are forfeited without refund, except where a refund is required by applicable law or provided by our Refund Policy.
Limitations of Service
Service Availability
- We strive for high uptime but cannot guarantee uninterrupted service
- Maintenance, updates, or technical issues may cause temporary unavailability
- We reserve the right to modify or discontinue features with notice
Accuracy Disclaimer
- Domain name suggestions are generated algorithmically and may not always be suitable
- We do not guarantee the commercial viability of suggested names
- Legal availability of domains should be independently verified
Trademark Screening Is Not Legal Advice
- Our trademark screening features perform automated, preliminary checks against selected trademark data sources. They are provided for informational purposes only.
- Trademark screening results are not legal advice, and your use of them does not create an attorney-client relationship. Screening is not exhaustive: it may miss unregistered (common-law) marks, marks in registries we do not check, foreign marks, phonetic or visual similarities, and pending applications.
- Before adopting, using, or investing in any name, you should conduct a full clearance search and consult a qualified trademark attorney. We are not liable for any claim arising from your adoption or use of a name, whether or not it was screened by the Service.
Beta and Preview Features
- We may offer features labeled beta, preview, early access, "coming soon," or similar. These are provided as-is, may be modified or withdrawn at any time without notice, may be subject to additional limits, and are excluded from any availability or performance commitments. Feedback on beta features is subject to the Feedback section above.
Payment and Subscription
Free Services
- Basic domain name generation and availability checking are provided free of charge
- Free usage may be subject to rate limits and feature restrictions
Subscriptions and Auto-Renewal
- Pro is offered as an auto-renewing Quarterly or Yearly subscription, or as a one-time Lifetime purchase. Payments are processed by Stripe.
- By starting a subscription, you authorize us to charge your payment method automatically at the start of each billing period, at the then-current rate for your plan, until you cancel.
- You may cancel at any time from your account settings or the billing portal. Cancellation takes effect at the end of the current billing period; you keep access (and your plan's features) until then. We do not provide prorated refunds for partial periods except as described in our Refund Policy or required by law.
- If we change the price of your subscription, we will notify you at least 30 days before the new price takes effect. The new price applies from your next renewal. If you do not agree, cancel before that renewal; continuing your subscription after the notice period constitutes acceptance.
- Where required by applicable law, we will send renewal reminder notices before charging.
Lifetime Plan
- "Lifetime" refers to the lifetime of the BetterNamer Service, not the lifetime of the purchaser. A Lifetime purchase provides access to the plan's features for as long as we commercially operate the Service and offer those features.
- If we permanently discontinue the Service, or materially discontinue the features included in the Lifetime plan, we will provide reasonable notice. Discontinuation does not entitle you to a refund except as provided in our Refund Policy or required by law.
- Lifetime access is personal to your account and is non-transferable.
Refunds
- Refunds and cancellations are governed by our Refund Policy, which is incorporated into these Terms by reference.
Domain Purchases and Renewals
- Domain registrations, renewals, transfers, and restores are one-time charges at the prices shown at checkout, plus any applicable ICANN transaction fee
- Completed domain registrations are generally non-refundable, as the registration is executed immediately at the registry
- If you enable auto-renew for a domain, you authorize us to charge your saved payment method annually, approximately 25 days before expiry, at the then-current renewal price — see the Domain Renewal & Expiration Policy. Auto-renew is off by default and can be disabled at any time.
Privacy and Data Protection
Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated by reference into these Terms.
Termination
By You
- You may terminate your account at any time through your account settings
- Upon termination, your access to the Service will cease immediately
- We will handle data deletion according to our Privacy Policy
By Us
- We may suspend or terminate accounts that violate these Terms
- We may discontinue the Service with reasonable notice
- In case of termination for violations, access may be revoked immediately
- Unused credits are handled as described in the Credits and Usage Limits section
Disclaimers and Limitations of Liability
Service Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERNAMER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL.
Maximum Liability
Our total liability to you for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless BetterNamer and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
Governing Law and Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.
Informal Resolution First
Before filing an arbitration or court claim, you agree to contact us at legal@betternamer.com with a description of your dispute and give us 30 days to work with you in good faith to resolve it. Most concerns can be resolved this way, quickly and at no cost.
Binding Arbitration
Any dispute arising from these Terms or your use of the Service that is not resolved informally shall be resolved by binding individual arbitration administered by National Arbitration and Mediation ("NAM") under NAM's Comprehensive Dispute Resolution Rules and Procedures in effect at the time the claim is filed, including the rules and fee provisions NAM applies to consumer disputes, available at namadr.com/resources/rules-fees-forms. The arbitration will be conducted by a single arbitrator, in English, and — unless you and we agree otherwise — by videoconference or on written submissions. If an in-person hearing is required, it will be held in the county where you reside. If NAM is unavailable or unwilling to administer the arbitration, the parties will select, or a court will appoint, a comparable arbitration provider pursuant to the Federal Arbitration Act.
Exceptions
Either party may instead: (a) bring an individual claim in small claims court if it qualifies; or (b) seek injunctive or other equitable relief in court for actual or threatened infringement or misuse of intellectual property.
Class Action Waiver
You and BetterNamer each agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and the remainder shall proceed in arbitration.
30-Day Opt-Out
You may opt out of this arbitration agreement by emailing legal@betternamer.com with the subject line "Arbitration Opt-out," including your name and account email, within 30 days of first accepting these Terms. Opting out of arbitration does not affect any other provision of these Terms.
Changes to Terms
We may update these Terms from time to time to reflect changes in our Service or legal requirements. We will:
- Post updated Terms on our website
- Update the "Effective Date" at the top of this document
- Notify users of material changes via email or Service notifications
- Continued use of the Service after changes constitutes acceptance of new Terms
Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, internet or utility outages, failures of registries, registrars, or other upstream providers, or denial-of-service attacks.
Assignment
We may assign these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer these Terms, your account, or any rights under them without our prior written consent; any attempted assignment in violation of this section is void.
Export Controls and Sanctions
You represent that you are not located in, or a resident of, any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government restricted-party list (including the OFAC Specially Designated Nationals list). You agree to comply with all applicable export control and sanctions laws in your use of the Service.
Entire Agreement and Order of Precedence
These Terms, together with the Privacy Policy, Refund Policy, Domain Registration Agreement, and Domain Renewal & Expiration Policy, constitute the entire agreement between you and BetterNamer regarding the Service and supersede any prior agreements. If these documents conflict: for domain registration matters, the Domain Registration Agreement and Domain Renewal & Expiration Policy control; for refund matters, the Refund Policy controls; otherwise, these Terms control.
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
